Ferdinand Waititu Submits New Request for Bail While Serving Prison Sentence

Former Kiambu Governor Ferdinand Waititu on Tuesday, March 18, submitted a new request seeking to be granted bond as he continues to serve a prison sentence following his conviction for corruption.

This new request came immediately after an appeal against his prison sentence was filed by the troubled former Governor, which remains unresolved.

Waititu was found guilty on Thursday, February 13, of unlawfully awarding a contract while serving as Kiambu County boss. He was sentenced to 12 years in prison or a fine of Ksh53. 5 million.

Waititu was sentenced to five years in prison or a fine of Ksh2.5 million. A Ksh51 million fine was also imposed by the court, and failure to pay it could result in an additional seven years in prison.

Milimani Anti-Corruption Court Chief Magistrate Thomas Nzioki also ordered Waititu’s wife Susan Wangare to pay a fine of Ksh500,000 or undergo one year imprisonment. The magistrate clarified, however, that the two sentences were to run concurrently.

Additionally, the court ruled that Waititu’s actions were unacceptable since they went against the fundamentals of good government.

The public’s trust in this matter has been flagrantly betrayed by the former governor and the co-defendant.

Waititu thus filed an appeal while requesting bail. The courts refused him bail following a successful motion by the Director of Public Prosecution (DPP) opposing his bail application.

In his appeal, Waititu expressed that he was unwell, citing chest pain and high blood pressure, but to no avail as Waititu continued to be incarcerated at the Industrial Area prison daily.

The Chief Magistrate also criticized the accused for altering academic documents, including certificates, stating that it is not appropriate at a time when young people are nearing unemployment.

 

 

Nzioka remarked that the defendants’ misconduct was intentional, unwarranted, and weakened the pillars of sound governance.

Waititu was imprisoned alongside Luka Mwangi Wahinya (previous Chief Officer of Roads, Transport, Public Works and Utilities), who received a sentence of 2 years in prison or a fine of Ksh1 million shillings, along with a compulsory fine of Ksh20 million in lieu of serving 5 years in prison.

Moreover, the directors of Testimony Enterprises Limited, the firm involved in the tender scandal, Charles Chege Mbuthia and Beth Wangeci Mburu, were sentenced to 4 years in prison or a fine of Ksh2 million shillings, accompanied by a mandatory fine of Ksh294 million and 3 years in prison or a fine of Ksh1. 4 million shillings, respectively.
